Executive Summary
Netherlands-based diagnostics manufacturer Organon Teknika has won a patent dispute concerning its NASBA HIV tests with Roche. The Swiss pharmaceutical company claimed in September that Teknika's test infringed Roche's European PCR patent. However, on December 14th the president of the district court at The Hague rejected all of Roche's claims and granted Teknika's counter-claim that Roche should publicly announce the contents of the judgement. Teknika says it has begun legal action in the UK, France and Germany to obtain declarations of non-infringement and is preparing similar action in other countries.
