Executive Summary
A San Diego District Court jury has ruled that Gen-Probe is the sole owner of two patents relating to ribosomal RNA probe testing. Regents of the University of California filed a suit against Gen-Probe and inventor Dr David Kohne in 1993 claiming that Dr Eric Stanbridge, a UC professor, had co-invented the technology in 1975. The case against Gen-Probe was funded by Amoco which had agreed to indemnify the Regents and Dr Stanbridge if the case were successful in return for a licence to the patents. San Diego-based Gen-Probe is owned by Japanese company Chugai Pharmaceutical.
