Executive Summary

Osteotech has settled litigation brought by Regeneration Technologies (RTI) and the Southeast Tissue Alliance over allegations that its bio-d threaded cortical bone dowel infringed certain patents. The Eatontown, New Jersey-based company chose to settle rather than face substantial legal fees and the potential awarding of damages. Under the settlement, Osteotech agreed to stop processing, marketing and selling the product and said it would not replace the product with any similar products infringing RTI patents. The case is related to one with Medtronic which Osteotech settled in April (see Clinica No 1006, p 21).
