Executive Summary
Aesthetic laser patent suit settlement calls for CoolTouch to pay Cynosure 10% royalties on future sales of CoolTouch's CoolLipo laser system for subcutaneous fat removal (lipolysis), and 9% royalties on previous sales, Cynosure announces Feb. 9. Cynosure, which makes the Smartlipo laser system for minimally invasive fat removal, also will receive 7.5% royalties on CoolTouch's future sales of systems sold for lipolysis and at least one other aesthetic procedure. Cynosure will split the royalties 60/40 with El.En., its patent licensor. CoolTouch also has granted a royalty-free license to Cynosure for CoolTouch fat-treatment technology. Cynosure says it will pursue licensing deals with other laser lipolysis firms it believes have infringed upon the '873 patent.
