Sen. Hatch (R-Utah) is contemplating legislation that would eliminate FDA as it currently exists and create independent device and drug offices under the Public Health Service. Also among ideas under consideration is relocating device center operations to the Senator's home state of Utah, according to staffers. Hatch is considering the measures out of concern that pharmaceutical regulatory concepts will be applied to the device program if the centers are not independent. Staffers plan to begin developing a "concept paper" on potential legislation in late April.
