Executive Summary
A jury verdict in favour of Fonar against General Electric on MRI patent infringement has been reduced on appeal. However, GE is filing another appeal in the Court of Appeals of the Federal Circuit in Washington. Of the two patents at issue, Federal Court Judge Leonard Wexler upheld one as infringed but reduced damages from $75 million to $62 million to be paid to MRI manufacturer Fonar. In addition, the court issued an injunction prohibiting GE from selling the infringing apparatus on its scanners, but the injunction is stayed pending appeal. Judge Wexler considered the second patent not to be infringed, saving GE $35 million in damages.
