Executive Summary
A US District Court has reduced an award made against Biomet in a patent infringement case relating to a bi-polar hip cup. The court held that although the Biomet device infringed the Ramos patent, the infringement was not literal or wilful and thus reduced the award from $6 million to $2 million (see Clinica No 566/7, p 2). The device, which is no longer manufactured by Biomet, accounted for less than 1% of annual sales.
