Executive Summary

Surgical Dynamics' implantation procedure for its Ray TFC spinal fusion cage was found by a US district court in Tennessee to infringe a patent held by Medtronic Sofamor Danek. The case will go to trial in September, with Tyco International subsidiary Surgical Dynamics maintaining that the patent is invalid. Sofamor is also asserting the same patent against Osteotech for its use of a method promoted by the company to insert its Bio-d threaded cortical bone dowel. That case is due for a hearing in June 2001.
