Executive Summary
VISX has chosen not to appeal the decision of the International Trade Commission (ITC), that found for Japanese manufacturer Nidek over a vital patent infringement matter for the refractive surgery laser manufacturer. VISX had asked the ITC court to ban Nidek from importing its products into the US (see Clinica No 899, p 14). This finalises the decision in favour of Nidek.
