TriPath wants court to dismiss Cytyc suit:

Executive Summary

TriPath Imaging, a competitor to Cytyc in the advanced cervical smear market, has asked the judge hearing Cytyc's patent infringement suit to throw out the case. Cytyc alleges that TriPath's preservative fluid copied Cytyc's (see Clinica No 876, p 10). TriPath has requested summary judgement and its president and CEO, James Powell, says: "We believe the court will find that this complaint has no factual merit and will rule accordingly. Our objective is to dispense with this lawsuit as quickly as possible."
