Executive Summary

At face value, it does not appear that medical devices and diagnostics will be impacted by the EU/US dispute over the US legislation on foreign sales corporations. But close scrutiny of the implications of this dispute for the medical devices sector is needed. As part of the EU countermeasures against the US legislation, the EU has published a list of tariffs on imports from the US of certain goods from the US, which could increase costs of products by up to 100%. But the European medical devices industry association is asking its members to check closely that the materials they use in their products are not covered and is offering to lobby for the removal of any of these products/materials from the list if necessary.
