Executive Summary
Fresenius Medical Care has resolved another piece of litigation dating back to its 1996 merger with WR Grace's National Medical Care. It has agreed an undisclosed out of court settlement with a group of commercial health insurers led by Connecticut General Life Insurance Company. The litigation involved allegations of excess medical services claims, and counter-allegations of delayed payments. Neither side admits liability. FMC CEO Ben Lipps said the company's 2001 provision for merger-related matters remained adequate. In December 2002 it settled an asbestos liability suit for $15m (see Clinica No 1036, p 14).
