Executive Summary

Avitar, the developer of oral fluid diagnostics, has settled a lawsuit initiated by its former supplier, Virotek. The complaint, filed by Virotek in November 2003, claimed that Canton, Massachusetts-based Avitar had retracted from an alleged purchase agreement involving 2 million units of rapid test strips from Virotek, resulting in the latter seeking over $4m in damages incurred through profit loss. Virotek, the Buffalo Grove, Illinois subsidiary of Efoora, dismissed the complaint after Avitar agreed to pay $47,500 for the purchase of a production tool valued at $50,000 in an earlier agreement between the two companies.
