Executive Summary
U.S. District Court in Marshall, Texas, denies firm's request for a new trial July 9 in a patent infringement case that leaves Boston Scientific paying $501 million to radiologist Bruce Saffran. A jury ruled in February in favor of Saffran's allegations that the Taxus and Taxus Liberté paclitaxel-eluting stents violate his patent related to the pourous stent coating (1"The Gray Sheet" Feb. 18, 2008, p. 14). Boston Scientific says it will now appeal the decision. Saffran has a similar case pending in the same court against Cypher stent-maker Johnson & Johnson
