Global breast implant settlement unravels; plaintiffs seek separate deals.

This article was originally published in The Gray Sheet

Executive Summary

CLAIMANT PROOF OF SILICONE BREAST IMPLANT MANUFACTURER will be required in order for the 440,000 plaintiffs in the global breast implant settlement to take part in settlement agreements that are being pursued with individual manufacturers following the collapse of the $4.23 bil. class action settlement. The failure of settlement negotiations the week of Sept. 4 leaves plaintiffs with the options of separate settlements or individual litigation against defendants; in either case plaintiffs would have to document the manufacturer of their implants in order to pursue claims.
