Executive Summary

Sentencing for Robert Hird, former president of the now- defunct Diversified Diagnostics Industries, Inc., is set for Dec. 22 in U.S. District Court in San Francisco. Hird is expected to receive a three-year sentence, FDAers say. On Sept. 21, a jury found Hird guilty of 21 felony charges following a two-week trial, according to FDA. Charges consisted of nine counts of introducing adulterated devices into interstate commerce, six counts of wire fraud, five counts of mail fraud, and one count of making false statements to FDA; he was acquitted of one count of mail fraud. The charges stemmed from a 1988-1991 scheme to sell diagnostic test kits that had not been approved by FDA, agency staffers said
