Scimed v. ACS

Executive Summary

Scimed Life Systems files suit in U.S. District Court for the Northern District of California against Lilly subsidiary Advanced Cardiovascular Systems alleging that ACS' Flowtrack 40 and Rx Elipse percutaneous transluminal coronary angioplasty catheters infringe on two of its patents (5,156,594 and 5,217,482). Scimed claims that ACS's infringement "is willful" and seeks to have the company enjoined "from selling the two products and to recover damages for the infringement." In late 1991, Scimed agreed to pay ACS $48 mil. plus royalties under a settlement of earlier PTCA- related infringement suits involving different patents ("The Gray Sheet" Dec. 2, 1991, p. 1)...
